Terms of Service

Welcome to Salad Days! These Terms of Service ("Terms") govern your use of the Salad Days mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have parental or guardian consent to use the App.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Use of the App

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

4.2 Prohibited Activities

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the App's functionality
• Use automated systems (bots, scrapers) to access the App
• Upload or transmit viruses, malware, or malicious code
• Impersonate any person or entity
• Violate the rights of others, including intellectual property rights

5. Subscriptions and Payments

5.1 Free and Premium Features

• Free Users: 5 Smart Function uses per day, with advertisements
• Premium Subscribers: 100 Smart Function uses per day, ad-free experience

5.2 Subscription Terms

• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Payment will be charged to your Apple ID or Google Play account upon purchase confirmation
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Manage subscriptions and turn off auto-renewal in your device's Account Settings after purchase
• No refunds for unused portions of a subscription period

5.3 Free Trials

If we offer a free trial, you will be charged the subscription fee after the trial period ends unless you cancel before the trial expires. Terms and duration of free trials may vary and are specified at sign-up.

6. User Content

6.1 Your Content

You retain ownership of any data you input into the App (food logs, exercise logs, etc.). By using the App, you grant us a license to use, store, and process your content solely to provide the App's services.

6.2 Photo Processing

Photos you capture or upload are processed temporarily for food detection and are not stored permanently. By using the photo features, you consent to temporary processing of your images.

7. Intellectual Property

The App, including its design, functionality, content, and trademarks, is owned by Biyootiful and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

8. Third-Party Services

The App integrates with third-party services (Supabase, AdMob, RevenueCat, USDA FoodData Central). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Disclaimers

9.1 No Medical Advice

IMPORTANT: The App provides nutrition information for educational and tracking purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider or registered dietitian before making dietary changes or health decisions.

9.2 Accuracy of Information

While we strive for accuracy, we do not guarantee that nutrition data, food detection results, or other information provided by the App is complete, accurate, or error-free. Use the App at your own discretion.

9.3 "As Is" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIYOOTIFUL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL ARISING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless Biyootiful and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Effective Date." Your continued use of the App after changes are posted constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in [Your Jurisdiction].

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be resolved through good-faith negotiations. If negotiations fail, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Biyootiful regarding the use of the App and supersede any prior agreements.
